GDPR: concepts, what data we collect, why we collect it


Below you will find explanations of some key phrases related to data protection. We also define which personal data we collect when you visit and use services ofsmaart.sk and smaart.online, for which purpose this data is used, what are the other conditions for its processing and how you can request erasure of collected personal data. We want to emphasize that we pay special attention to the protection of your personal data and it is used mainly for administrative purposes (accounting, taxes) and to improve our customer services (statistics, sales analyses, advertising). The collection and processing of personal data is carried out on the basis of the consent given by the user or for contractual purposes. If you do not want us to store your personal data, we will delete them immediately and permanently. For more information, see the description below.


Web tracking and analytics


Using Google AdWords, Google Analytics, Google Search Console we track traffic and customer behavior on our site. The data collected includes: time spent on our website, number of clicks, subpages visited, age, gender and approximate location of the user, their anonymized
IP address, browser type, device type (mobile, laptop, tablet, desktop…). The data collected also helps us set up ads through Google AdWords and Facebook. The data is anonymized when compiling statistics.


IP address


The IP address is transmitted whenever you make a request to the server. This lets the server know where the response to that request should be sent. Every Internet user has a unique IP address assigned to him by his Internet service provider. As long as the IP address is stored, it is theoretically possible to indirectly identify the owner of the IP address. For this reason, IP addresses are not permanently stored by us or our statistical service providers, but are only used to determine where the server response to your request should be sent. IP addresses in our system are stored anonymously, the last octet is not specified, so that the stored data remains anonymous forever and cannot be further indirectly attributed to a specific user.


Cookies


Cookies are small text files that are stored on your computer and can be saved by your browser. Cookies cannot be linked to a specific person and do not contain any personal data. This data will only be combined with other sources of data about your person if you have given us your explicit consent at smaart.sk or smaart.online.
Most often we use temporary cookies (so-called session cookies), which will be deleted at the end of the browser session. In addition, there are also long-term cookies (“permanent cookies”) with which we can recognize you as a visitor. Cookies do not cause any damage to your computer and do not contain any viruses.


Log files


Every time you access smaart.sk or smaart.online, usage data is transmitted by your internet browser and saved in log files called Server Log Files. The data sent in this way contains the following information: date and time of access, URL of the page, IP address, previous URL (so called referrer), amount of data sent, and the User Agent transmitted by the browser (for example, type and version of the browser and operating system used). IP addresses are stored exclusively in anonymous form for evaluation purposes. Evaluations of the data offerings of these Logfiles in an anonymized form serve to identify and correct errors as quickly as possible. Through the processing of this data it is also possible to adjust the server capacity and improve our offer.


Contact form


For your convenience and quick communication with us, we have placed a simple contact form at smaart.sk or smaart.online. After filling in the basic data (name, email, text content of the message itself), the message is forwarded to our email (info@smaart.sk). The incoming message and its content is used only for communication and solving the subject of the message (interest in the service, questions, etc.).


Embedded content from other websites


Articles on this site may contain embedded content (e.g., videos, images, articles, etc.). Embedded content from other sites behaves just as if the visitor were visiting another site.
These websites may collect personal information about you, use cookies, embed third party tracking tools and track your interactions with embedded content, including tracking your interactions with embedded content if you have an account and are logged in to that website.

Secure data transfer


Your personal data is transmitted securely thanks to encryption. We use the SSL (Secure Socket Layer) encryption system. We protect our website as well as other systems of processing personal data by appropriate technical and organizational measures against loss, destruction, modification and further distribution of data. Your data can only be accessed by authorized persons and only to the extent necessary for administrative or corporate marketing purposes.

What rights you have with regard to your data


If you have an account on this site or have subscribed to our newsletter, you may request the export of personal data we keep about you, including data you have provided to us. You may also request that your personal data be deleted. However, this does not apply to data that we must delete about you for administrative or legal reasons.


Right to information and other rights of data subjects


You have the right to be informed free of charge about the processing of your stored data. Subject to the requirements set out in generally applicable law, in particular those set out in Chapter III of Regulation (EU) 2016/679European Parliament and Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (“GDPR”), you also have the following:

  • The right to access your personal data (Article 15 GDPR);
  • The right to restrict the processing of personal data (Article 18 GDPR);
  • the right to object to the processing of your personal data for direct marketing purposes (Article 21 GDPR );
  • the right to delete personal data (Article 17 GDPR),
  • in particular if they are no longer needed for the purposes for which they were collected or otherwise processed, or if you have withdrawn your consent to their processing and if there are no other legitimate grounds for processing, or if the personal data have been processed unlawfully;
  • The right to data portability (Article 20 GDPR),
  • That is, you have the right to receive your personal data, which you have voluntarily provided to us electronically on the basis of your consent or for the performance of a contract, in a structured, generally accepted and machine-readable format, and in this context you may request the right to transfer this data to another controller, as far as such transfer is technically feasible (right of data portability).

Right to object to processing under Article 21 of the GDPR


You have the right to refuse the processing of your personal data for direct marketing purposes at any time, in which case the personal data will no longer be processed for such purposes. If we process your data for our legitimate interests, you may opt out of such processing, in which case we may only continue to process your personal data if we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms or if the data is necessary to establish, exercise or defend legitimate claims. The processing of your personal data does not involve decisions under Article 22 of the GDPR based solely on automated processing that has legal consequences that concern you or similarly significantly affect you.


Non-consent to data use, retention period and data deletion


You have the right to withdraw your consent to data processing at any time. Your withdrawal of consent does not affect the legality of the data processing carried out on the basis of this consent prior to its withdrawal. The retention period of cookies depends on your browser settings. We will immediately delete all of your personal data, except for those that by their nature cannot be deleted because they are subject to the statutory deadline (in particular documentation relating to tax and accounting).


Supervisory authority


As a data subject, you have the right to complain to the supervisory authority, which is the Office for Personal Data Protection of the Slovak Republic, located at Hraničná 12, 820 07 Bratislava, in particular if you suspect that your personal data is processed in violation of applicable law.
